Our Client was charged with two (2) counts of Theft in Dwelling under Section 380 of the Penal Code, Cap 224. After we spoke to our Client, our experience in such cases told us that our Client’s behaviour might be ‘kleptomaniac’ (an impulsive urge to steal). We advised our Client to undergo the Psychiatry Report. Our Client’s condition was later confirmed in the Psychiatry report. Under the Law, this offence requires a compulsory imprisonment (i.e. jail sentence). We successfully argued for a lighter sentence for our Client. We succeeded in arguing that our Client to receive a Mandatory Treatment Order. There was no jail sentence.
